Who can apply?
- People who are un a residency process.
- In this waiver, the petitioner must carry out the process verifying that his/her spouse, father or mother (citizen or legal residents), would be seriously affected if the case is not approved.
- Legal residents can initiate proceedings in favor of spouse, children under 21 years of age, single, or over 21 years old, single.
What do you need?
- Demonstrate a reliable family relationship.
- Supporting documentation that shows that the qualifying family member would be seriously impacted if the case is not approved (each case is different and it is necessary to provide economic, health, social evidence, etc).
- Evaluation of the beneficiary’s immigration and/or criminal history (admissibility requirement to migrate to the Unites States).
- The necessary documentation and/or evidence will depend on the type of personal case of each individual.
