The Family Petition is the process by which citizens or legal residents of the United States apply for permanent residence for certain eligible family members. There are different family categories and waiting times vary according to the type of relationship and the availability of visas. Who can apply?
- Citizens of the United States can initiate proceedings in favor of spouses, or children under 21 years of age or over 21 years of age, single, married, parents and siblings.
- Legal residents can initiate proceedings in favor of spouse, children under 21 years of age, single, or over 21 years old, single.
What do you need?
- Demonstrate a reliable family relationship.
- Documents that prove the reliable family relationship.
- Evaluation of the beneficiary’s immigration and/or criminal history (admissibility requirement to migrate to the Unites States).
- The necessary documentation and/or evidence will depend on the type of personal case of each individual.
